The PPWR applies from tomorrow. The Ministry has issued guidance on how to implement it

On 4 August 2026, the Ministry of the Environment of the Slovak Republic issued guidance on the implementation of EU Regulation 2025/40 on packaging and packaging waste (PPWR).

The PPWR applies directly and in full from 12 August 2026, even though the amendment to the Slovak Waste Act, which will ensure its alignment with the PPWR, has not yet been adopted.


Who is a packaging producer?


From 12 August 2026, the definition of a packaging producer under the PPWR will apply when determining who is a packaging producer.


Important: The previous definition of a packaging producer under Section 52(11) of the Waste Act will no longer apply from that date. Packaging producers must therefore assess their status in accordance with the new definition set out in the PPWR.


What does this mean for packaging producers?


The change in definition may affect who is an obligated party and who is responsible for fulfilling the obligations arising from extended producer responsibility (EPR).


Important: The fact that the Slovak Waste Act has not yet been harmonised with the PPWR does not mean that the application of the PPWR has been postponed. The Regulation is directly applicable from 12 August 2026.
