WHO IS THE PACKAGING PRODUCER?
The packaging producer is not the entity that produces the packaging itself. It is therefore not a producer of empty plastic bottles, paper boxes, glass bottles, beverage cartons or metal cans. A packaging producer is a natural or legal person who:
- packs or fills goods into packaging and markets them under its own brand name,
- is the person for whom the goods are packaged or filled and under whose brand name they are marketed,
- imports and markets packaged products,
- distributes packaging (for a fee or free of charge) to the end user for the immediate packaging of goods (the packaging in which the customer packs the goods),
- as a distributor, uses packaging to wrap goods or to fill with goods (packaging in which the sales assistant packs goods for the customer),
- provides empty packaging (both free of charge and for a fee) to the final consumer.
Definition of packaging
Packaging, within the meaning of Section 52 of the Waste Act, is a product used for packaging, protection, handling, delivery and presentation of goods, from raw materials to products, from the producer to the user or consumer, which meets the criteria set out in Annex 7 of the Waste Act 79/2015 Coll.; non-returnable parts of packaging used for the same purposes are also considered to be packaging.
